What the police account actually says

Around noon on Wednesday 19 January 2011, Santa Monica officers saw Jud Birza riding a skateboard in the street. Skating in the roadway is a vehicle code violation in Santa Monica, and that is what started the encounter. It was not a traffic stop, and no car was involved.

During the stop officers ran a database check that turned up an outstanding warrant connected to an earlier DUI matter. Police said they also concluded he was under the influence of a controlled substance, and that the earlier matter had left him on probation. He was booked on all three items, bail was set at $37,000, and the Santa Monica Daily Press reported he was released that night.

A warrant is not a conviction, and booked is not charged

This is the part that gets mangled every time the story resurfaces. Birza was not convicted of DUI in January 2011. What police found was a warrant, which is an order to bring someone before a court, not a finding by one. Being booked on suspicion of being under the influence is likewise an arresting officer's conclusion at the roadside, not a verdict.

The probation violation sits in the same category. Police alleged one. Nobody has produced a revocation ruling, and an allegation of a violation is not a judgment that a violation occurred. Where the sourcing comes from

The result nobody ever published

The contemporaneous local report was explicit that the question of what substance was involved had not been answered. Testing was pending and no conclusion had been drawn. Fifteen years on, no published test result has been found, so the central factual claim in the booking, that he was under the influence of a controlled substance, was never confirmed by anything beyond the officer's assessment at the scene.
