How the case ended

On 15 July 2021 Silas Gaither pleaded guilty in a Memphis courtroom to two counts of aggravated assault. The sentence was six years of probation and a condition barring contact with the victims. Stacy Jacobson reported the plea and the terms for WREG the next morning, and an Internet Archive capture taken on 16 July 2021 preserves that report with the same wording.

That is the disposition. It is not the ending most write-ups of Gaither carry, because the counts he was indicted on in 2019 are heavier than the counts he pleaded to, and the indictment is the part that travelled.

What he was charged with in 2019

A Shelby County, Tennessee grand jury indicted Gaither in November 2019. Action News 5 in Memphis reported the counts as rape and aggravated assault, tied to an incident alleged to have taken place between 10 and 20 May 2018. He posted a $50,000 bond and was released.

WREG's later account of the same prosecution describes a broader pre-plea case: three rape counts, sexual battery and aggravated assault, involving two women. Every one of those was a charge. A charge is what the state alleges at the start, and here the state resolved the matter by accepting a plea to two aggravated assault counts.

Why "convicted of rape" is wrong

Gaither was not convicted of rape. On the available record the rape counts did not produce a conviction, and the case ended with a guilty plea to aggravated assault. That gap is the whole point of this page: the difference between what a prosecutor alleged in an indictment and what a court entered as a judgment.

Two adjacent claims also fail on the record. No source reviewed here establishes sex offender registration. And no CBS statement, sanction or ban has been found, so calling him banned from Survivor asserts something nobody has shown.

Which season he actually played

Gaither played Survivor: Africa, the third season, which aired in 2001. He started on Samburu, moved to Boran, and was the fifth castaway voted out, on day 15. He has never returned to the show.

Summaries that place him on Survivor: Thailand have the wrong season and, in most cases, the wrong person. If a page says Thailand, treat everything else on it with the same suspicion.

What is still open

The current status of the six-year probation term is unverified. A judgment sheet or supervision record would sit in the Shelby County Criminal Justice System portal, which requires a registered sign-in for name searches, so no docket could be opened without one. Nothing here should be read as saying the probation was completed, and nothing here should be read as saying it was revoked.
